What is the Non Lucrative Visa?
The Non Lucrative Visa (NLV) is designed for non-EU/EEA and non-Swiss foreigners who wish to live full time in Spain, but without working there or making a large investment in the country (such as for the Spain Golden Visa).
(NLV) allows foreigners to get residency based on proof of sufficient economic means, originating from a source outside Spain, €28,800 being the required amount for the 1st Person, Iprem amount for 2nd and Subsequent €7,200.
*Iprem will can and does change often in the new tax year for spain Jan to Dec..
These amounts can be made up of passive income (state pension, occupational pensions), savings (including investments and pension pots) or a combination of the two.
*€28,800 for information is 4 X IPREM (Indicador Público de Renta de Efectos Múltiples).
The IPREM is announced by the Spanish authorities annually in January, it can increase so you need to be aware that financial requirements can also increase.

Requirements

Criminal record check certificate:
The criminal background check must be issued by the U.S. Department of Justice – Federal Bureau of Investigation (FBI). State background checks issued by the Department of Law Enforcement and those issued at a local level will not be accepted. The background check must be issued within the five months preceding the submission of the visa application. It must be authenticated with the Apostille of The Hague of Washington DC (US Department of State) and translated into Spanish.

Medical certificate. Applicants requiring a visa for a stay of more than 180 days must submit the original and a copy of a medical certificate accrediting that they do not suffer from any disease that could cause serious repercussions for public health pursuant to the 2005 International Health Regulations.

Healthcare,
Health insurance. Original and a copy of the certificate accrediting the public or private health insurance with no co-pay (or deductible) contracted with an insurance entity authorized to operate in Spain. The insurance policy must be valid for 1 year and must cover all the beneficiaries of the visa for the risks insured by Spain's public health system. No travel insurances with medical assistance coverage will be accepted.

Proof of financial means.
The applicant must submit the originals and a copy of the documents proving that they have sufficient financial means to cover the expenses of residing in Spain for the initial year of the residence permit, or accrediting that they have a regular source of income, for themselves and, where applicable, for the family members accompanying them.
The minimum required amount is equivalent to 400% of Spain's Public Multiple Effects Income Indicator (IPREM).
To this amount must be added 100% of the IPREM for each family member in the applicant's care. As the first Paragrapgh.
Documentation in original form with an official stamp and seal of the issuing agency that verifies sufficient economic means for the period of residency in Spain or certifies the availability of a non-working monthly income (eg. pension) that satisfies the minimum financial requirements.
If you are of working age, you will need to prove receipt of a pension or provide a termination letter from your employer stating that you will no longer work for that company or, in case of self-employment, you will need to provide an affidavit before a Notary stating that you agree not to work while residing in Spain.
In the case of retirees, the applicant must be a beneficiary of a State pension in convertible currency or be a beneficiary of a life annuity, not capitalizable, payable by a public or private institution in convertible currency and / or investment accounts.

Residency applicants cannot have/leave loans or mortgages in the United States when applying for residency in Spain.

Whats Next After Approval?
Upon receiving the Approval, the NIE will be issued if you don't already have one, and it will be included in your Visa.
You will be required to collect the Visa in your passport, if permitted, or it will be sent to you along with the Visa.
The Schengen visa is valid for 90 days, providing ample time to settle in Spain. You can request multiple entries to delay the TIE process if you are not prepared, which is common.
We offer guidance and resources for obtaining the padron once you arrive, although the process varies by region, and we do not charge for this service. The padron is necessary for the TIE appointment. Subsequently, we assist in scheduling your TIE appointments, providing all necessary documents and instructions.
We do not accompany you to the appointment to keep costs low, as the process is straightforward and routinely conducted by immigration officials. The 30-day timeframe for obtaining the TIE on consulate paperwork after entry is somewhat outdated, considering the challenges in securing appointments in certain regions. Therefore, there is no need for concern. We will arrange appointments for you anywhere in Spain through Expay.

All Residents of Spain are obliged to submit a first year tax return, Even if you submit one in the birth country, any taxes paid will be noted and deducted as per the DT rules, but ALL world wide income as to be declared, especially after the Modelo 720 has been submitted (See Below)

Expected Changes in 2025:
While the exact requirements for 2025 may change, some likely adjustments could include:

Stricter Proof of Funds: Spain has been gradually tightening residency rules to ensure non-lucrative visa holders have sustainable finances. There may be more scrutiny on the types of funds or assets used to meet the financial requirements, and additional documentation may be required.

The Modelo 720. Does this apply to you?
The obligation to file Form 720 lies on Spanish residents and legal persons who, at any time during the year own;
Foreign Bank Accounts: Money in banking institutions abroad.
International Investments: Securities representing equity in foreign entities.
Property abroad, including any rights associated with them.
Spanish residents are individuals to spend over 183 days in Spain, which makes one a Fiscal Resident
Remember it is not for any money or assets held in Spain, overseas only
This includes individuals, beneficiaries, representatives, and companies with rights of disposal or full ownership.
Even if some or all of the foreign holdings were sold before the end of the year, they must be reported.
For foreign assets acquired as gifts or inheritance, the cost amount is considered as the fair market value at the time of receipt.
The M720 is an informative submission and no Tax will be due on this form, it is to let the Spanish Government know what you have outside of Spain, as this can be subject to Taxes due if assets are sold and money has earned interest for example.
Due Date for Filing:
The tax form needs to be submitted before 31st March of every year.
