Here’s your complete, up-to-date guide — including legal references, what documents to bring, how to handle appointments, and exactly when you can apply.

ONLY applies to those in their 5 year Pre-brexit Renewal Card

📜 Official Legal Basis

These are the current legal and official sources governing renewals:

  • BOE Royal Decree 557/2011, Article 51.1 — Renewal must be applied for within 60 calendar days before your card expires. Read the official text here (in Spanish)

  • BOE Resolution 2 July 2020 — Establishes the Brexit residency rules under Article 50. Official BOE link

  • Spanish Ministry of Inclusion & Migration Brexit Guidehttps://extranjeros.inclusion.gob.es/es/brexit/index.html

  • Ministerio de Trabajo y Economía Social – Immigration FAQshttps://www.mites.gob.es

🗓 When Can You Apply?

Legally, you can apply within the final 60 calendar days before your TIE expires.

Applying too early may result in your application being rejected and a new appointment required.

⚠️ Some extranjería offices prefer 30 days or less, even if the law allows 60.

At Expay, we always prepare for both, and will advise you based on your location.

🔁 Can You Stay in Spain If Your Card Expires?

Yes. Under the Withdrawal Agreement, your residency rights remain protected if:

  • Your card expires while waiting for a renewal

  • You apply just after expiry (within a reasonable time)

✅ You remain legal and can continue living and working in Spain during this period.

📋 What Documents Do You Need?

Legally, only the following are required:

  • EX-23 form (TIE renewal)

  • Valid passport

  • Current Article 50 TIE

  • Payment proof for Modelo 790 (Tasa 012)

  • Recent passport photo

🧾 Real-World Practice: Additional Documents?

While these are the only legal requirements under Article 50, some local police offices (depending on region and officer) may ask for:

  • 🟨 Recent padrón certificate (especially if not updated) please ask for for assistance

  • 🟨 Proof of continued residence (rental contract, utility bills)

  • 🟨 Proof of income, healthcare, work status – not legally required, but may be requested in some cases (especially if you have been away or are changing address)

🧠 Our approach at Expay:

We assess your personal situation and prepare a tailored checklist. Each case is different — what was accepted in Alicante may not be enough in Granada.

✅ Best Practice:

Rather than confronting the police at the desk, it’s usually better to:

  1. Comply calmly with their request if it’s reasonable and you have the documents.

  2. Take note of what was asked and politely request it in writing, if possible.

  3. Appeal afterwards if you feel the request was unlawful, especially with legal backing.

📅 How to Book Your Appointment

All renewals must be done in person at your local Policía Nacional office.

There are now two appointment categories:

  1. General “TIE (EX23)” renewal

  2. Specific “Brexit (UK Nationals Article 50)” renewal – available in some provinces

We constantly monitor both types and will book the most appropriate slot for you.

🚨 Where are the Brexit-specific slots?

They vary, but have been seen in:

  • Madrid

  • Valencia

  • Málaga

  • Alicante

  • Murcia

  • Palma de Mallorca

If available in your province, we will prioritise these.

🔄 Upgrading to a 10-Year Card (Permanent Residency)

You can renew for a 10-year “Permanente” card if:

  • You’ve lived legally in Spain for 5 years

  • This includes time on a green EU certificate or an earlier TIE

Even if your 5-year card isn’t about to expire, you can upgrade once your 5 years of residence are complete.

We’ll calculate your eligibility and guide you through the upgrade process.
